Terms of Service

1. Agreement to These Terms
These Terms of Service ("Terms") govern your access to and use of the One Tehillim mobile application and the website at onetehilim.com (collectively, the "Service"), operated by One Tehillim ("we", "us", or "our"). By accessing or using the Service—including by applying to run or running a fundraising campaign—you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. The Service
One Tehillim provides a platform that lets organizations and individuals ("Organizers") present fundraising campaigns to our community, and lets supporters ("Donors") contribute to those campaigns. We provide the listing, presentation, and management tools. We are not a charity, broker, fundraiser, payment processor, or merchant of record for campaigns, and we do not take custody of campaign funds.
3. Fees and Payments
- Zero platform fee. We do not charge Organizers a platform fee or success fee and we take no percentage of donations.
- Organizers use their own payment processor. Organizers connect their own payment processing account (such as Stripe, Cardknox, Sola, or Banquest). Donations are processed by, and settle directly into, the Organizer's own account. We never hold, control, or disburse campaign funds.
- Processing fees still apply. Standard card-processing and provider fees charged by the Organizer's payment processor still apply and are the Organizer's responsibility. "Zero fees" refers solely to fees charged by us.
- No guarantee of funds. We are not responsible for any failed, reversed, disputed, or fraudulent transactions, or for the acts or omissions of any payment processor.
4. Applications, Review, and Approval
Campaigns are not published automatically. Every application is subject to review, and we may approve, decline, request changes to, suspend, or remove any application or campaign at our sole discretion, with or without reason. Approval is not an endorsement of, or a representation about, any Organizer or campaign. You are responsible for the accuracy and completeness of everything you submit.
5. Organizer Responsibilities
If you apply to run or run a campaign, you represent and agree that:
- You are authorized to act on behalf of the organization you represent and to raise funds for the stated purpose.
- All information you provide—including legal, tax, and contact details—is accurate, current, and complete.
- You will use funds raised solely for the purpose represented in your campaign.
- You are solely responsible for your campaign, including delivering on any commitments, issuing tax receipts where applicable, complying with all applicable laws (including charitable solicitation, tax, sweepstakes, and consumer-protection laws), and handling any donor refunds or disputes.
- You will maintain your own payment processor account in good standing and comply with its terms.
6. Prohibited Uses
You may not use the Service to:
- Engage in fraud, misrepresentation, money laundering, or any unlawful activity;
- Raise funds for unlawful, deceptive, hateful, violent, or harmful purposes;
- Infringe the intellectual property, privacy, or other rights of any person;
- Upload malicious code or attempt to disrupt, probe, or gain unauthorized access to the Service; or
- Misrepresent your identity, your organization, or how funds will be used.
7. Your Content
You retain ownership of the text, images, and other materials you submit ("Your Content"). You grant us a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute Your Content for the purpose of operating, promoting, and improving the Service. You represent that you have all rights necessary to grant this license and that Your Content does not violate these Terms or any law.
8. Donations
Donations are transactions between the Donor and the Organizer (and the Organizer's payment processor). We are not a party to those transactions. Whether a donation is tax-deductible depends on the Organizer's tax status and applicable law, and any tax receipt is the Organizer's responsibility. Requests for refunds should be directed to the Organizer.
9. Accounts
You are responsible for maintaining the security of your account and for all activity that occurs under it. You agree to provide accurate account information and to notify us promptly of any unauthorized use.
10. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not endorse, guarantee, or assume responsibility for any campaign, Organizer, or the use of any funds raised. We do not warrant that the Service will be uninterrupted, secure, or error-free.
11. Limitation of Liability
To the maximum extent permitted by law, One Tehillim and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of funds, profits, data, or goodwill, arising out of or relating to your use of the Service or any campaign, even if advised of the possibility of such damages. Because we charge no platform fee and never hold campaign funds, our aggregate liability for any claim relating to the Service is limited to the greater of the amounts you paid us (if any) or one hundred U.S. dollars ($100).
12. Indemnification
You agree to indemnify and hold harmless One Tehillim and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your campaign, Your Content, your use of the Service, or your violation of these Terms or any law.
13. Suspension and Termination
We may suspend or terminate your access to the Service, or remove any campaign, at any time and at our sole discretion, including for any violation of these Terms. You may stop using the Service at any time.
14. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms on this page with a revised "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules, except where applicable law requires otherwise. You agree that the state and federal courts located in New Jersey will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.
16. Privacy
Your use of the Service is also governed by our Privacy Policy.
